Client was charged by Clearcreek Township Police with Operating a Motor Vehicle under the influence of alcohol in violation of RC 4511.19 (A)(1)(a), Hit Skip/Leaving the scene of an accident in violation of RC 4549.02 and Failure to maintain reasonable control in violation of RC 4511.202.   Client was observed by a citizen who called 911 that Client had hit a utility pole with her mirror, knocking same off. Police responded to her residence where the officer administered the Horizontal Gaze Nystagmus Test (HGN) and Client refused any further field tests and breath test. A trial to the bench was held, where client was found not guilty. She was convicted of the failure to maintain reasonable control, a minor misdemeanor.
