Fairfield OVI/DUI

Client was charged by Fairfield Police with 4511.19 (A)(1)(a), Operating a Motor Vehicle under the influence of alcohol and 4511.19(A)(1)(h) a “high tier” OVI, Operating a Motor Vehicle with a concentration of greater than .17 of one gram by weight of alcohol per two hundred ten liters of her breath (BAC), which was measured by the Fairfield Police at .286. Client was found in his car passed out with the car running, in gear and with a beer can in his hand. This was the second OVI he had received in 2 days.   No field sobriety tests were administered.   Counsel was able to work out a plea to a “low tier” OVI with minimal sentencing, including only having to serve 3 days in a Driver’s Intervention Program.
