Client was charged by Ohio State Highway Patrol with 4511.19(A)(1)(a) Operating a Motor Vehicle under the influence of alcohol, 4511.19(A)(1)(f), Operating a Motor Vehicle with a concentration of greater than .17 of one per cent or more by weight per unit volume of alcohol in the person’s whole blood (BAC), which was measured by at the Ohio State Patrol at .191 on a Intoxilyzer 8000 instrument. Client was also charged with a marked lane violation. Counsel was able to point out problems with the Intoxilyzer 8000 machine, and the charges were dismissed.
