Hamilton Area II OVI/DUI Case

Client, who was 20 years old, was charged by Ohio State Patrol with Operating a Motor Vehicle Under the Influence of Alcohol a violation of 4511.19(a)(1)(a), and Operating a Motor Vehicle with a prohibited level of alcohol in her blood as measured by the Intoxilyzer 8000 breath machine at .112 a violation of 4511.19(a)(1)(d), speeding in violation of 4511.21(D)(2), and Underage Consumption of alcohol in violation of 4301.69.   Trooper approached vehicle and noticed a strong odor of alcohol, client admitted to drinking earlier and the Trooper performed one Standardized Field Sobriety Test, namely the Horizontal Gaze Nystagmus Test (HGN), which the Trooper indicated he found 6 out of 6 clues, and arrested Client. Counsel was also to negotiate a plea to a reduced charge of Reckless Operation and have the remaining charges dismissed.
