Hamilton Area II OVI/DUI Case

Client was charged by Ohio State Patrol with Physical Control of a Vehicle Under the Influence of Alcohol a violation of 4511.194. Client was stopped on side of highway as he had run out of gas. Trooper approached vehicle and noticed an odor of alcohol, client admitted to drinking earlier and the Trooper performed one Standardized Field Sobriety Test, namely the Horizontal Gaze Nystagmus Test (HGN), which the Trooper indicated he found 6 out of 6 clues, and arrested Client. Client refused to provide a breath test, and was placed on a one year administrative license suspension (ALS). Counsel was able to attack the ALS and have it terminated, and the matter was set for trial. At trial,   Counsel was able to negotiate a plea to a reduced charge of Improper Equipment, in violation of 4513.02. Client was fined only.
