West Chester OVI/DUI

Butler County Area III Court, Case No. TRC 08-6520: Client was charged by Ohio State Patrol with Operating a Motor Vehicle Under the Influence of Alcohol and marked lanes. The officer performed standardized field sobriety tests, namely the Walk and Turn and Horizontal Gaze Nystagmus tests and the client refused a breath test. Counsel was able to negotiate a plea to a reduced charge of Reckless Operation.

Area II OVI/DUI

Butler County Area II Municipal Court, Case No. 09TRC981: Client was charged by Butler County Sheriff with Operating a Motor Vehicle Under the Influence of Alcohol a violation of 4511.19 and Left of Center in violation of 4511.23, after the client went left of center and collided head on with another vehicle. Client admitted to drinking to the officer, but was unable to perform any field sobriety tests due to injuries, and refused to provide blood or urine at the hospital and was placed on a one year administrative license suspension (ALS). Counsel was able to negotiate a plea to a reduced charge of Reckless Operation, and have the ALS terminated and the fee waived.

Butler County Area II Municipal Court, Case No. 09TRC155: Client was charged by Ohio State Patrol with Physical Control of a Vehicle Under the Influence of Alcohol a violation of 4511.194. Client was stopped on side of highway as he had run out of gas. Trooper approached vehicle and noticed an odor of alcohol, client admitted to drinking earlier and the Trooper performed on Standardized Field Sobriety Test, namely the Horizontal Gaze Nystagmus Test (HGN), which the Trooper indicated he found 6 out of 6 clues, and arrested Client. Client refused to provide a breath test, and was placed on a one year administrative license suspension (ALS). Counsel was able to attack the ALS and have it terminated, and the matter was set for trial. At trial, Counsel was able to negotiate a plea to a reduced charge of Improper Equipment, in violation of 4513.02. Client was fined only.

Butler County Area II Municipal Court, Case No. 09TRC00258: Client was charged by Ohio State Patrol with Marked Lanes a violation of 4511.33, 4511.19(A)(1)(h) a “high tier” OVI, Operating a Motor Vehicle with a concentration of greater than .17 of one gram by weight of alcohol per two hundred ten liters of her breath (BAC), which was measured by the Ohio State Patrol at .232. Client was stopped for marked lane violations, was asked to perform Standardized Field Sobriety Tests, but was unable to due to lack of balance and stumbling. Counsel was able to negotiate a plea to a reduced charge and obtain the minimum mandatory sentence.

Fairfield OVI/DUI

Fairfield Ohio Municipal Court, Case No. 08TRC04741: Client was charged by Ohio State Patrol with Marked Lanes a violation of 4511.33, 4511.19 (A)(1)(a), Operating a Motor Vehicle under the influence of alcohol and 4511.19(A)(1)(d), Operating a Motor Vehicle with a concentration of greater than .08 of one gram or more but less that .17 of one gram by weight of alcohol per two hundred ten liters of his breath (BAC), which was measured by the City of Fairfield Police department at .112. Client was stopped for marked lane violations, submitted to 3 standardized field sobriety tests, which the officer indicated he did poorly on, and a portable breath test (PBT) which registered a .09. Counsel set the matter for Motion to Suppress the results of the stop, field sobriety tests and the breath test, and the afternoon of the motion, counsel was able to negotiate a plea agreement to a lesser charge of Reckless Operation.
