Client was charged by Fairfield Police with 4511.19 (A)(1)(a), Operating a Motor Vehicle under the influence of alcohol. Client was stopped for driving erratically and driving at night without her headlights on. Client submitted to 3 standardized field sobriety tests, which the officer indicated she did poorly on. Counsel set the matter for Motion to Suppress the results of the stop, field sobriety tests and challenging probable cause for the arrest. The Court overruled the motion and the matter was set for jury trial. A week before the trial, counsel was able to negotiate a plea agreement to a lesser charge of Reckless Operation.
